DMCA Copyright and Intellectual Property Policy

PsyData Labs L.L.C., a New York limited liability company ("PDL", "we", "us", or "our"), respects the intellectual property rights of others and expects our users, clients, and partners to do the same. In accordance with the Digital Millennium Copyright Act of 1998, Title 17 of the United States Code, Section 512 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our websites, applications, behavioral telemetry services, and AI-driven analytics platforms (collectively, the "Services") if such claims are reported to our Designated Copyright Agent identified below.

1. Notification of Copyright Infringement (Takedown Notice)

If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through our Services by completing a DMCA Notice of Alleged Infringement ("Notice"). Upon receipt of a valid Notice, we will take whatever action, in our sole discretion, we deem appropriate, including removal of or disabling access to the challenged content from our production, staging, or research environments.

To be effective under 17 U.S.C. § 512(c)(3), your Notice must be in writing and include all of the following:

• Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
• Identification of the Copyrighted Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
• Identification of the Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (such as the specific URL, dataset tag, or inference output).
• Contact Information: Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
• Good Faith Statement: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• Statement of Accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please note that for security and classification purposes, all DMCA notices and ensuing correspondence will be processed within our internal systems in compliance with our data governance standards and logged for auditable SLA tracking.

3. Counter-Notice Procedure

If you believe that your material that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material within our Services, you may send a Counter-Notice containing the following information to our Designated Copyright Agent:

• Signature: Your physical or electronic signature.
• Identification of the Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
• Good Faith Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
• Contact Information & Consent to Jurisdiction: Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located (or if your address is outside of the United States, for the Southern District of New York), and that you will accept service of process from the person who provided the original Notice or an agent of such person.

If a valid Counter-Notice is received by our Copyright Agent, we may send a copy of the Counter-Notice to the original complaining party informing them that we may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider or user, the removed material may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the Counter-Notice, at our sole discretion.

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, PsyData Labs L.L.C. has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, subscribers or account holders who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Services, restrict deployment to our AI models, and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

5. Misrepresentations and Penalties

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to severe legal liability, including costs and attorneys' fees incurred by the alleged infringer, by any copyright owner, or by PDL. As such, if you are not certain whether material infringes your copyright or whether it was removed by mistake, you should strongly consider consulting legal counsel before submitting a Notice or Counter-Notice.

6. Cross-Policy Alignment and Data Processing Constraints

This DMCA Copyright Policy integrates with our broader internal governance frameworks (including CCPA/CPRA, NY SHIELD Act, and GDPR requirements). Please note the following PDL-specific constraints:

• Personal Information: The processing of any personal or contact information contained in DMCA Notices and Counter-Notices is subject to our Privacy Policy and documented Lawful Basis frameworks.
• Data Classification: When enforcing this policy, any actions involving behavioral data (D-BEH), psychological signals (D-PSY), or AI inference outputs (D-INF) are subject to our stringent access controls and composite classification tagging (S1-S4).
• Legal Holds: Upon receipt of a valid infringement Notice, PDL will issue an internal Legal Hold within 24 hours to preserve relevant records in accordance with FRCP requirements and our internal Legal Hold procedures, suspending standard automated deletion workflows for the affected materials.

7. Modifications to This Policy

We reserve the right to modify, alter, or update this DMCA Copyright Policy at any time. Any such modifications will be reviewed by the Managing Member, appropriately versioned, and become effective immediately upon posting to our Services. Your continued use of our Services after the posting of any revised policy constitutes your acceptance of the revised terms.
