Takedown Notice Requirements
To submit a valid DMCA takedown notice, the complainant must provide:
Identification of the copyrighted work claimed to be infringed;
Identification of the material claimed to be infringing and its location on PDL platforms;
Complainant's contact information (name, address, telephone, email);
A statement that complainant has a good faith belief that use of the material is not authorized by the copyright owner, its agent, or applicable law;
A statement, under penalty of perjury, that the information in the notice is accurate and complainant is authorized to act on behalf of the copyright owner;
Electronic or physical signature of the copyright owner or authorized agent. 12. Counter-Notice Procedure
A party whose content has been removed pursuant to a DMCA takedown may submit a counter-notice to the Designated Agent. The counter-notice must include: identification of the removed material; statement under penalty of perjury that removal was erroneous; consent to jurisdiction; and contact information. Upon receipt of a valid counter-notice, PDL will forward it to the original complainant. If PDL does not receive notice of legal action within ten to fourteen (10–14) business days, PDL may restore the removed content at its discretion.
Repeat Infringer Policy
PDL will terminate accounts of users who are determined to be repeat infringers of third-party copyright. A determination of repeat infringement will be made by PDL in its sole discretion based on the number and pattern of valid DMCA takedown notices received.
Scope Limitation
The DMCA process set forth herein applies to user-generated content hosted on PDL platforms. PDL's own Intellectual Property, including software, models, documentation, and brand assets, is separately protected by copyright, trade secret, trademark, and other applicable law. Unauthorized use of PDL's proprietary content is addressed through PDL's separate enforcement mechanisms and is not subject to counter-notice procedures.
False Claim Liability
Under 17 U.S.C. § 512(f), any person who knowingly makes material misrepresentations in a DMCA takedown notice or counter-notice may be liable for damages, including costs and attorneys' fees, incurred by any party injured by such misrepresentation.
